Welcome to KAYAKKRUZER. These Terms and Conditions govern all bookings, participation in activities, and merchandise purchases associated with 

KAYAKKRUZER. By booking, hiring, or participating in any service provided by KAYAKKRUZER, you agree to the following terms:

Participation and Safety

All participants engage in kayaking and associated activities at their own risk. KAYAKKRUZER undertakes all reasonable measures to ensure a safe and enjoyable experience, but cannot eliminate all risks inherent in outdoor water-based activities. All participants are required to wear personal flotation devices (life jackets), which will be supplied. Compliance with all safety instructions issued by KAYAKKRUZER staff is mandatory.

Children under the age of 10 must share a double kayak with a responsible adult. KAYAKKRUZER reserves the right to refuse service or remove any individual deemed unfit to participate due to intoxication, medical concerns, non-compliance, or conduct that may endanger others.

Participants must disclose any existing medical conditions, injuries, or relevant health issues prior to commencing any activity. Failure to do so may result in removal from the activity without refund.

Risk Acknowledgement and Liability Waiver

By participating in KAYAKKRUZER activities, you acknowledge the potential risks involved, including but not limited to capsizing, physical exertion, variable weather conditions, and contact with natural elements. To the fullest extent permitted by law, you agree to release and indemnify KAYAKKRUZER, its directors, employees, contractors, and agents from any liability, claim, or demand resulting from injury, damage, or loss incurred in connection with your participation.

Bookings, Cancellations and Refunds

Full payment is required at the time of booking unless otherwise agreed in writing. Cancellations made with more than 48 hours’ notice may be eligible for a full refund or booking credit. Cancellations within 48 hours of the activity start time are not eligible for a refund.

Failure to attend a booked session without prior notice will be treated as a “no-show” and is non-refundable. Should KAYAKKRUZER cancel an activity due to poor weather, river conditions, safety concerns, or insufficient participant numbers, a full refund or alternative session will be offered.

Weather and Environmental Conditions

KAYAKKRUZER reserves the right to cancel or postpone sessions in response to adverse weather or unsuitable river conditions. Activities may proceed in light rain or cool temperatures, but will be halted if conditions are deemed unsafe. Participants will be notified as early as possible in the event of cancellation, and suitable alternative arrangements will be offered.

Equipment Hire and Responsibilities

KAYAKKRUZER provides kayaks and related equipment in sound working order. Participants are responsible for all hired equipment during the session and agree to return it in the condition it was provided. Damage caused through misuse or negligence may incur additional charges. Instructions regarding care and handling of equipment must be followed at all times.

Merchandise Sales

All merchandise purchases are final. Returns or exchanges will only be considered for faulty items, which must be reported within 14 days of receipt and returned in unused condition with proof of purchase. Refunds for defective items will be issued at the discretion of KAYAKKRUZER.

Media and Photography

KAYAKKRUZER may capture photographs or video footage during activities for promotional and marketing purposes. By participating, you consent to your image being used unless you notify us in writing in advance of the session. KAYAKKRUZER will respect any such requests.

Health and COVID-19

Participants experiencing cold, flu, or COVID-19 symptoms are asked to refrain from attending and to notify KAYAKKRUZER as early as possible. KAYAKKRUZER will accommodate rescheduling or issue a credit where appropriate. Activities will be conducted in accordance with current public health guidelines.

Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any dispute arising under or in connection with these terms shall be resolved in accordance with applicable Australian legislation.
